Plaintiff Suits Against Automakers Get Lost In Shuffle

There has been a lot of talk of late about the impact of our poor economy on the big three automakers. Much ado has been made about the use of bailout monies, who’s taking it and who isn’t and about the long term effects that the bankruptcy of one of them might have on American life. Throughout all of these discussions one important element has been placed on the back burner: Personal injury plaintiffs. Several people have pending personal injury suits against Chrysler, which is up for sale at this point and GM which is filing for bankruptcy. Once both companies emerge from the mire of fiscal and managerial irresponsibility, they will do so according to one source “…free and clear of all pending and future claims and interests in all property sold pre-bankruptcy”. What makes matters worse is that the law seems unclear and open to interpretation on this subject.

It appears that those who have filed suits had better get in line. The legal wrangling and arguments regarding this topic have only just begun. We don’t see it getting settled anytime soon. At the heart of all this is the fact that the victims in these suits are being victimized once again. In some cases people have lost limbs or their ability to perform routine tasks due to mechanical issues or malfunctions in an automobile. Medical bills are piling up and they are now unable to work and provide for themselves or their loved ones. Now, their cases may become a moot issue due to all the financial wizardry that is currently manifesting itself.

To us at westonlawyers.com, that is an injustice. There should be a legal remedy in place that isn’t subject to the whims of financial mismanagement. The laissez faire perspective that got these companies into trouble in the first place is now spilling over in other ways and having an even more negative impact on the true victims. It seems in all of the budgets, bailouts and bankruptcies, they have all but been forgotten.

This story is still developing and we have every intention of following through. In our opinion these will be cases in which legal precedent will be set for the future.
